As we continue our evolution as a thriving, full-service firm, we are delighted to announce our merger with Falcon Rappaport & Berkman LLP (FRB), effective April 1, 2024. Business will continue as usual for our clients, who will now benefit from a broader array of legal services, as well as the expanded capabilities of a sophisticated, midsize firm.
FRB is based in Long Island, with an established presence in New York City, New Jersey, South Florida, and California. November 10, 2023 — On November 9, Co-Managing Partner Moira Laidlaw spoke at the JCC Mid-Westchester in Scarsdale in conjunction with the Alzheimer’s Association. The topic was: “Dementia Conversations: Top Ten Estate Planning Mistakes.”
Ms. Laidlaw is a Certified Elder Law Attorney (CELA), one of approximately 400 attorneys in the United States who hold this designation, as accredited by the National Elder Law Foundation and the American Bar Association. As an executive committee member of the New York State Bar Association’s Elder Law and Special Needs Section, Ms. Laidlaw is one of an elite group of attorneys who help advocate and set policy on matters that impact the elderly and special needs community. She frequently lectures and educates on topics such as Medicaid as it relates to long-term care financing; special needs planning; and probate, estates, and gift tax issues. Ms. Laidlaw is also a member of the Society of Trust and Estate Practitioners (STEP). STEP, a global organization whose members come from 98 countries, is the global professional association for practitioners who specialize in family inheritance and succession planning.

P. Daniel Hollis III and HLS are Honored
May 26, 2023 — P. Daniel Hollis III and Hollis Laidlaw & Simon, P.C. were recently recognized for their pro bono counsel and support of Neighbors Link at Festival de Primavera 2023, the organization’s annual spring benefit. Neighbors Link is a non-profit based in Mount Kisco, dedicated to strengthening the community through the holistic integration of immigrants. Years ago, when Mr. Hollis was the President of the Westchester County Bar Foundation, he was instrumental in coordinating the funding that would make it possible for Neighbors Link to offer immigration legal services to the community. Since then, Neighbors Link’s immigration law team has grown into a vital resource for the immigrant community, while Mr. Hollis and HLS have provided pro bono general counsel services to help the organization conserve resources while pursuing its mission.

Douglas E. Singer Joins Hollis Laidlaw & Simon
January 4, 2023 — Hollis Laidlaw & Simon welcomes Partner Douglas Singer to our Trusts & Estates and Corporate Practices. Mr. Singer focuses his practice in the areas of corporate law, estate planning and social enterprise law. On the corporate side, he works with privately held businesses and their owners, and has worked extensively with women and minority business owners. His work includes matters ranging from setting up entities to negotiating and drafting contracts to the purchase and sale of companies. In estate planning, the hallmark of Mr. Singer’s approach is effective communication – active and careful listening, and explaining complex concepts in plain English, not legalese.
In his social enterprise practice, Mr. Singer works with companies that are as much about making a difference in the world as making money – in other words, companies pursuing significant initiatives designed to have social or environmental impact. He creates and works with benefit corporations and benefit limited liability companies, works with clients seeking to become Certified B Corporations, and advises clients in their development of programs designed to further their mission and impacts.
An active member of the Business Council of Westchester for many years, Mr. Singer currently serves as its general counsel and on the board of directors and executive committee. He is the current board chair and a member of the board of trustees of The Leukemia & Lymphoma Society, Westchester Hudson Valley Lower Connecticut Area.
Prior to joining Hollis Laidlaw & Simon, Mr. Singer worked with Webster & Sheffield and Stroock & Stroock & Lavan in New York City. Thereafter he was a co-founder and principal of Falcon & Singer P.C. and the founder and managing member of Singer Law PLLC. Kimberly Bliss Becomes a Shareholder at Hollis Laidlaw & Simon
January 3, 2023 — Congratulations to Senior Partner Kimberly Bliss on becoming a shareholder of Hollis Laidlaw & Simon. Kimberly counsels individuals and families on trusts & estates issues, focusing on gift and estate tax matters, special needs planning and elder law. She is particularly adept at assisting clients in settling the estates of their loved ones, long-term care needs and navigating and applying for Medicaid benefits.
As one of the firm’s owners, Kimberly will continue to be involved in firm management decisions, as she has for many years. Her roles in firm leadership include coordinating Hollis Laidlaw & Simon’s educational program for the Trusts & Estates practice and mentoring attorneys who are new to the practice. A respected leader in the elder law field, Kimberly regularly gives presentations to attorneys and the community on long-term care planning. She is an active member of the New York State Bar Association’s Trusts and Estates Section and Elder Law Section.
Kimberly began her law career as an associate at Moira Laidlaw’s practice, Laidlaw Firm, in 2011 and joined Hollis Laidlaw & Simon (then Shamberg Marwell) when the two firms merged. She became a partner in January 2019. Before practicing law, Kimberly worked at White Plains Hospital for 10 years; she draws upon her healthcare experience to inform and strengthen her Elder Law practice.

HLS Celebrates Its 50th Anniversary
Fifty Years with Hollis Laidlaw & Simon: Evolution Rooted in Excellence
When Stu Shamberg incorporated our law firm in 1972, concentrating the practice in land use & zoning law, he couldn’t have imagined that 50 years later, the firm would grow to include a new generation of talented lawyers, robust practice areas like trusts & estates, expanded practices in land use & zoning, corporate, real estate, litigation & dispute resolution, guardianship, and employment, and hundreds of loyal clients from all over Westchester and neighboring counties, as well nearby states, Connecticut and New Jersey.
But today, Hollis Laidlaw & Simon has evolved into a thriving full-service firm, due in no small part to what our founders established those 50 years ago: a commitment to excellence.
“Stu had a tremendous reputation, which served as the foundation for us to grow and grow and be burnished by all the successful cases that we’ve had through the years,” said Partner Dan Hollis, who joined the firm in 1990 and bridges the gap between the days of Stu Shamberg and retired Partner John Marwell, and today’s other named partners Moira Laidlaw and David Simon.
One of our most booming practice areas, trusts & estates, has certainly benefited from that foundation. Laidlaw, who heads the practice, said, “We recognized pretty quickly after I joined the firm in 2014 what synergies there were between the firm’s phenomenal litigation & land use practice and my trusts & estates experience.”
Now the trusts & estates practice is nine lawyers and eight staff strong, helping over 300 families a year. “It’s like a little success story,” Laidlaw said humbly.
The trusts & estates practice includes estate planning and administration, and also covers high-net-worth tax planning, guardianship, and Medicaid asset protection.
The firm further evolved with the addition in 2018 of Managing Partner Simon, who bolstered the firm’s corporate and litigation practices. “Dave was an amazing find,” said Laidlaw. “He is a crazy throwback jack-of-all-trades because he’s amazingly good at corporate governance, commercial litigation, real estate litigation, guardianship litigation, and employment law. No one practices like that anymore. Lawyers who specialize are not always equipped to evaluate complex issues where multiple practice areas intersect. This is where Dave’s multidisciplinary experience proves to be invaluable for our clients.”
While we have developed into a full-service firm, our long-standing relationships in the community have remained strong. “The people we deal with know our reputation,” Simon said. “We’re well-known and respected in the courts in which we practice and by the planning and zoning boards whom we appear before, because Stu, John, and Dan set a very high standard that the firm remains committed to upholding.”

December 23, 2022 — Westchester Women’s Bar Association (WWBA) has been working to advance legal issues involving women since its inception in 1974. Each month, the WWBA features an interview with a member. Our own Moira Laidlaw spoke with Susan Pollet, Chair of the WWBA Archive and Historian Committee this month. Moira discussed her work with the WWBA and what she’d like to see the organization accomplish in the future. Moira Laidlaw Interviewed by Super Lawyers on the Importance of Setting Up A Special Needs Trust
November 16, 2022 — Moira Laidlaw was interviewed for a Super Lawyers article entitled “Setting Up A Special Needs Trust in New York.” The article discussed the importance of working with an estate planning lawyer to set up a special needs trust (“SNT”) for beneficiaries with special needs. An SNT ensures that funds can only be used for certain purposes, such as housing, recreational experiences, and items or services not covered by Medicaid, and can’t be used for anything that would disqualify the beneficiary from benefits.
Laidlaw stated, “We have a phrase at our practice: ‘planners win.’ It’s particularly true in the area of special needs planning. Because when parents or grandparents give inheritance to a person with special needs, it’s really important that they plan ahead of time in their estate plan for that money to go to trust rather than to go directly to the person with special needs.”
Laidlaw said that the most effective SNTs are done ahead of time, rather than as a direct inheritance. “If the money goes directly to the person with special needs, at least in New York, in that moment the options that the person has to protect that money are far more restrictive. It can still be protected, so all is not lost. It’s just that that money is now what’s known as a ‘first-party special needs trust’ as opposed to a ‘third-party special needs trust.’”
Moira stressed that caregivers “should also be focused on their own advanced directives, in case they lose capacity at any point in their own lifetimes. It’s important for them to get the basic estate planning issues solved correctly and proactively. You don’t want to create added unnecessary legal complexity where there’s already complexity that’s part of your family picture.”

Moira Laidlaw Authors NYLJ Article About Underutilized Tool in Estate Planning
September 19, 2022 — Moira Laidlaw authored a New York Law Journal article entitled “Mental Health Directives in Estate Planning Engagements,” in which she discussed the psychiatric advance directive (PAD), an underutilized new tool designed for clients with a history of mental illness.
In the September 9 article, Laidlaw explained that a PAD can help clients take control of their treatment plan in the event of a future mental health episode. A PAD will typically include: 1) the person authorized to make psychiatric decisions in the event of an episode; 2) the preferred hospitals and providers; 3) effective treatment therapies and medications to be administered; and 4) ineffective therapies and medications that are not to be administered.
Laidlaw wrote, “A fully developed PAD can serve as both a medical history of the patient and informed consent for future treatment… With current medical research showing a strong correlation between prompt treatment and better health outcomes, a PAD that allows for swift administration of treatment could be lifesaving.”

Fifty Years with Hollis Laidlaw & Simon: Evolution Rooted in Excellence
When Stu Shamberg incorporated our law firm in 1972, concentrating the practice in land use & zoning law, he couldn’t have imagined that 50 years later, the firm would grow to include a new generation of talented lawyers, robust practice areas like trusts & estates, expanded practices in land use & zoning, corporate, real estate, litigation & dispute resolution, guardianship, and employment, and hundreds of loyal clients from all over Westchester and neighboring counties, as well nearby states, Connecticut and New Jersey.
But today, Hollis Laidlaw & Simon has evolved into a thriving full-service firm, due in no small part to what our founders established those 50 years ago: a commitment to excellence.
“Stu had a tremendous reputation, which served as the foundation for us to grow and grow and be burnished by all the successful cases that we’ve had through the years,” said Partner Dan Hollis, who joined the firm in 1990 and bridges the gap between the days of Stu Shamberg and retired Partner John Marwell, and today’s other named partners Moira Laidlaw and David Simon.
One of our most booming practice areas, trusts & estates, has certainly benefited from that foundation. Laidlaw, who heads the practice, said, “We recognized pretty quickly after I joined the firm in 2014 what synergies there were between the firm’s phenomenal litigation & land use practice and my trusts & estates experience.”
Now the trusts & estates practice is nine lawyers and eight staff strong, helping over 300 families a year. “It’s like a little success story,” Laidlaw said humbly.
The trusts & estates practice includes estate planning and administration, and also covers high-net-worth tax planning, guardianship, and Medicaid asset protection.
The firm further evolved with the addition in 2018 of Managing Partner Simon, who bolstered the firm’s corporate and litigation practices. “Dave was an amazing find,” said Laidlaw. “He is a crazy throwback jack-of-all-trades because he’s amazingly good at corporate governance, commercial litigation, real estate litigation, guardianship litigation, and employment law. No one practices like that anymore. Lawyers who specialize are not always equipped to evaluate complex issues where multiple practice areas intersect. This is where Dave’s multidisciplinary experience proves to be invaluable for our clients.”
While we have developed into a full-service firm, our long-standing relationships in the community have remained strong. “The people we deal with know our reputation,” Simon said. “We’re well-known and respected in the courts in which we practice and by the planning and zoning boards whom we appear before, because Stu, John, and Dan set a very high standard that the firm remains committed to upholding.”

Shamberg Marwell Hollis Andreycak & Laidlaw, P.C. has changed its name to Hollis Laidlaw & Simon P.C., ushering in a new era with new leadership, a growing team, and expanded services.
Thirty-year partner Dan Hollis, managing partner Moira Laidlaw and partner David Simon comprise the new leadership team. Mr. Simon, who joined the firm in 2018, has bolstered the litigation and land use practices, expanded the corporate practice, and added an employment practice. “I am honored to take a leadership role at such an exceptional firm,” said Mr. Simon. “I was drawn to the firm because of the collaborative nature of our attorneys and the obvious benefit to the client when we put our minds together.”

SMHAL Wins Judgment Against Town of Bedford
This matter is a combined Article 78 proceeding and Declaratory Judgment action challenging a local law adopted by the Town of Bedford Town Board that regulates the preservation of historic buildings outside of the existing historic districts in the Town. As part of the local law, the Town Board adopted criteria for identifying “historic” properties and regulations requiring review by a historic building commission of any proposed demolition or alteration of the buildings on those identified properties. The Town Board also incorporated into the law a survey identifying hundreds of properties in the Town that it determined should be subject to the local law.
Shamberg Marwell Hollis Andreycak & Laidlaw was retained by Mr. and Mrs. Santomero, who own property in the Town affected by the local law. On behalf of the Firm’s clients, the Firm sought court review of both the constitutionality of the law and the procedure undertaken by the Town Board to adopt the law. In particular, the Firm urged the Court to find that the adoption by the Town Board of an inventory of historic properties en masse, without notice and public hearing as to each property, was in violation of the property owners’ due process rights. The Town sought dismissal of the constitutional claims and the remaining causes of action.
By Decision and Order of the Court (Hon. Anne E. Minihan), dated December 11, 2018, the Court denied the Town’s motion to dismiss the constitutional claims, and remanded to the Town Board “for a hearing, upon due notice, as to each property listed on the Survey.” The remaining causes of action of the proceeding were dismissed.
